Waiver of Liability and Release

The undersigned understands and acknowledges that training, exercising or using the equipment at The Training Lab South Boston, LLC (“Training”) may expose me to many inherent risks, which risks may  include, but are not limited to: falls, accidents, injury or death. I further acknowledge that The Training Lab South Boston, LLC has advised me to obtain a physical examination or opinion from a doctor before using any exercise equipment or participating in any exercise activity. And the undersigned acknowledges that acceptance of any recommendation for changes in diet or nutrition, or the use of food supplements, are entirely my decision. As consideration for the right to participate in Training, the undersigned hereby agrees with The Training Lab South Boston, LLC, its affiliates, managers, members, officers, officials agents, employees, staff, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Training (the “RELEASEES”), as follows:

1. I KNOWINGLY AND FREELY ASSUME ALL RISKS, arising from my participation in Training, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.

2. I agree for myself and on behalf of my heirs, assigns and personal representatives to WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Releasees AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer as a result of my participation in Training DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY DUTY OF CARE, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD  OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN any Training.

3. I, agree for myself and on behalf of my heirs, assigns and personal representatives, to HOLD HARMLESS the Releasees, WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property resulting from my participation in Training, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Photo Release 

I hereby grant The Training Lab South Boston, LLC permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of The Training Lab South Boston, LLC and will not be returned.

I hereby irrevocably authorize The Training Lab South Boston, LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge the The Training Lab South Boston, LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW. I ACCEPT:
